The Commission decisively acts to promote the competition and free market principles in the instrumentation and design of economic, sectorial and regulatory policies; also to advocate for favorable regulatory frameworks for competition and market efficiency. For that, it has an essential tool: opinions on competition and free market issuing.     

The Commission has the power to issue opinions on bills, regulation drafts, regulations, rules, agreements and any kind of administrative acts as well as program adjustments and public policies regarding their effects on competition and free access to markets. Also, CFC can issue opinions on current regulatory framework (laws, regulations, etc).

There are two kind of opinions, ones that have legal effects (binding opinions)  and those that haven´t. The no-binding opinions are issued regard to bills and regulations draft as well as current regulation. Commonly, this kind of opinions are issued by the CFC´s Chairman.  

The "binding opinions" can be addressed to Public Federal Administration bodies regard to program adjustments and public policies, as well as regulations draft. The Plenum has the power to issue this opinions. The recommendations set forth in the binding opinions are obligatory for the bodies, unless the Federal Executive Chairman object the opinion.

The Commission´s power to issue opinions is set forth in article 24 sections VI, VII, VIII, X and XI of the LFCE. Opinions are public and you can view here.
